  1. This Privacy Policy is issued by Azimuth Global Partners Sdn. Bhd. (Company No. 201101025572 (953708-A)) ("AGP" or "we") as a data user pursuant to the Personal Data Protection Act 2010 ("PDPA"), and it shall apply to all persons (each known as "Stakeholder") who browses, uses or accesses the website at www.azimuthglobalpartners.com ("Website"). References to "you" and any cognate expression in this Policy shall mean the Stakeholder.
  2. For the purposes of this Policy, the expression "personal data", "data subject", "data user" and "data processor" shall have the meaning as defined in the PDPA.
  3. The data subject hereby consents that we may collect, record, hold, store, process and/or otherwise use their data in accordance with this Policy and the PDPA. The data subject shall be deemed to have given such consent to us if he browses, uses or accesses the Website ("Engagement"). This consent shall remain applicable as long as the Engagement continues. The data subject shall not enter into the Engagement with us if the data subject does not accept the terms and conditions stated herein (including any amendments to this Policy) or disagree with the way we collect and process personal data. For the purposes of this Policy, "data subject" includes (but not limited to) any Stakeholder.
  4. We reserve the right at our sole discretion at any time to immediately suspend and/or terminate the Engagement in the event the Stakeholder refuses to grant or withdraws the consent referred to in paragraph 3.

During the course of our activities we may collect, record, hold, store and/or process personal data about the Stakeholder in any medium whether electronically or otherwise, for the purposes of the Engagement and any other purposes permitted under the law and the PDPA, and we recognise that the correct and lawful treatment of this data will maintain the confidence of Stakeholder in us.
  6. Personal data includes (but not limited to) name, address, copies and details of identification documents, contact details, details of bank account, employment history, credit and references check, marital status, commission or alleged commission of offence, personal financial and social security detail. We may also collect, record, hold, store and/or process the following information: device information, log information, browsing history, internet protocol address, cookies and location information.
  7. We may also collect, record, hold, store and/or process your information from other sources, including but not limited to third party background checks, any registered credit reporting agency, any regulatory authorities and any authority, central depository or depository agent.
  8. We may conduct any checks on the Stakeholder including but not limited to obtaining any litigation and default information, any information relating to company intelligence, business intelligence, individual credit intelligence, company profile, business profile, individual business profile and any other credit information from any credit reporting agency as we may think necessary.
  9. When data subject provides data to us, the data subject shall be deemed to have given consent to us to process the data in accordance with this Policy.
  10. Data processors include any person or organisation that is not a data user that processes personal data on our behalf and/or on our instructions. Such data processors shall comply with this Policy when processing any data on our behalf and/or on our instructions.
  11. You hereby acknowledge, confirm and consent that we may collect, record, hold, store and/or process your data for the following purposes:
    (a) in all matters pertaining to the Engagement;
    (b) for the purposes of processing your request and/or queries;
    (c) for the purposes of providing you with our services;
    (d) to conduct analysis and evaluation of our website and services in order to assist us to improve our website and services;(e) monitoring compliance with the agreement in paragraph (a) and our rules and policies and any other applicable laws;
    (f) complying with the compliance and disclosure requirements of any and all governmental and/or quasi-government departments, agencies, regulatory and/or statutory bodies;
    (g) complying with any legal obligation binding on us under any law, rule, regulation, by-law, order, guideline, directive, policy and such other requirements in force and as amended from time to time;
    (h) enforcing our rights under the agreement in paragraph (a) and our rules and policies or any other applicable laws to defend our rights;
    (i) for the purposes of record-keeping in the ordinary course of our business;
    (j) for the purposes of circulating, transmitting and/or delivering to you, by any means (including emails, short messaging services, regular mails and other means), any promotional materials (including products, services, new launches, upcoming events, promotions, advertisements, marketing and commercial materials); and
    (k) for any purposes relating to or in connection with the Engagement.
  12. We may track your visits to our Website by placing a "cookie" on your computer or other access device when you browse our Website. You may have the ability to accept or decline cookie. If you choose to decline cookies, that may hinder performance and impact your experience on our Website.
  13. The Stakeholder, whether past, current or prospective, shall be aware that failure to supply the relevant data to us may affect our ability to perform our obligations with the relevant person and/or affect the Stakeholder’s ability to enjoy their respective benefits from us.
  14. Data held by us relating to the Stakeholder will be kept confidential and we may provide such information to the following parties for the purposes set out in paragraph 11 above:
    (a) other Stakeholders;
    (b) our affiliates and associated companies;
    (c) any person to whom we are under an obligation to make disclosure under law, rule, regulation, by-law, order, guideline, directive, policy;
    (d) any court and/or officer of the court;
    (e) our auditors;
    (f) our legal advisers and compliance professionals;
    (g) our banks; and
    (h) our professional advisers, service providers and vendors.
  15. You are responsible for ensuring that the data that you provide to us is accurate, complete and not misleading and that such data is kept up-to-date, and you shall promptly keep us informed in the event the data is inaccurate, incomplete, misleading or not up-to-date and you shall provide us the true, accurate, complete, and updated data.

References to "your data" in this Policy shall include the data of such other person.

The continuation of the Engagement shall be treated as your agreement to the amendments.
